Latin term (analogously "may the buyer beware") is a legal principle according to which, in a contract of sale, the buyer bears the risk that the object of sale is free of open material defects and defects of title. If the buyer was able to recognise them, the seller's liability for defects is excluded. The right to complain about defects is derived from this. See also under wine trade and farm-gate sales.
